Work visa

Conditions for issuance of entry visa for foreigners entering Vietnam
To be granted an entry visa to Vietnam, foreigners need to meet the following 4 conditions:
- Have a passport or document valid for international travel as prescribed;
- Not in cases not yet allowed to enter under the Immigration Law 2014;
- There must be agencies, organizations and individuals in Vietnam to guarantee (except for subjects in the case of visa application NG1, NG2, NG3, NG4);
- Documents proving the foreigner’s purpose of entry (as the case may be), such as:
- Work permit in accordance with the Labor Law if applying for a work visa;
- Documents proving the investment in accordance with the Law on Investment if applying for an investment visa;
- License to practice in accordance with the Law on Lawyers if applying for a visa to practice law;

Visa application for foreigners
Depending on the purpose of foreigners applying for a visa to Vietnam, the application for a visa will be regulated differently. However, basically the application will include the following documents:
- Vietnam visa application form – form NA1;
- Letter of entry for foreigners;
- Passport (valid for at least 6 months) or document valid for international travel;
- Documents proving the entry purpose of foreigners as prescribed (documents proving investment, work permit…).

Visa application procedures for foreigners

- Confirmation of temporary residence registration:After obtaining a visa, foreigners need to confirm their temporary residence registration at the district-level police office where they are living.
- Apply for a work permit:In case of needing to work in Vietnam, foreigners need to apply for a work permit.
- Pay taxes and insurance: Ensure compliance with tax and social insurance regulations depending on the type of investment and labor.

Visa application period for foreigners entering Vietnam
- SQ, EV visas are valid for no more than 30 days.
- Visas marked HN, DL are valid for no more than 03 months.
- VR symbol visa is valid for no more than 06 months.
- Visas marked NG1, NG2, NG3, NG4, LV1, LV2, DT4, DN1, DN2, NN1, NN2, NN3, DH, PV1, PV2 and TT are valid for no more than 12 months.
- Visas marked LĐ1 and LĐ2 are valid for not more than 02 years.
- Visa symbol DT3 is valid for no more than 03 years
- Visas marked LS, DT1, DT2 are valid for no more than 05 years.
- Expired visas, considered for new visas.
- The duration of the visa is shorter than the validity of a passport or document valid for international travel of at least 30 days.
- Unless otherwise provided for in treaties to which Vietnam is a contracting party, the visa duration shall be granted according to international treaties.

Visa extension application
For Vietnam investor visa extension, an application for investor visa extension should contain
- Certified copy of Business License/Investment License.
- Certificate of registration of seal sample or Notice of posting information on seal sample of enterprise on the national portal on business registration; and Form NA16: Registration of seal sample and signature of the legal representative of the enterprise or organization operating in Vietnam. There is no need to submit these 2 items if the business has submitted once at the Immigration Department.

- Original passport valid as prescribed
- Registration form for temporary residence as prescribed.
